SOFTWARE PRODUCTS AND SERVICES ARE PROVIDED, AS IS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CLUBMZ.COM, DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF THE USE, OF THE WEB SITES, PRODUCTS, SERVICES OR WRITTEN MATERIALS IN THE TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS OR OTHERWISE. THE ENTIRE RISK, AS TO THE RESULTS AND PERFORMANCE OF THE WEB SITES, PRODUCTS AND SERVICES ARE ASSUMED BY YOU. IF THE WEB SITES, PRODUCTS, SERVICES OR WRITTEN MATERIALS ARE DEFECTIVE, YOU, AND NOT CLUBMZ.COM, ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

1B. SOFTWARE WARRANTIES AND DISCLAIMERS:

PRODUCTS, INCLUDING SOFTWARE, ARE SOLD WITHOUT WARRANTY, EITHER EXPRESSED OR IMPLIED, INCLUDING WARRANTY AS TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.



2. CREDIT CARD CHARGES AND CREDIT CARD FRAUD PENALTIES

Buyer warrants that he or she is over 18 years of age, not subject to the Child Online Privacy Act, of legal age to enter into contractual agreements in the state in which he is present when he makes this purchase, and is the true and authorized owner of the credit card used to make this purchase. Any Buyer who violates any of these requirements may be liable for civil or criminal prosecution and agrees to pay liquidated damages of an amount the equivalent of US$10,000 per fraudulent transaction, plus actual damages, and agrees that all information collected by this website may be used for prosecution and may be turned over to law enforcement agencies or to credit card companies and merchant service providers.

If the true and/or authorized owner of the credit card attempts to commit fraud upon the Seller, he authorizes each and every credit card company or merchant service provider to disclose to the Seller all information that could be construed as proof of credit card fraud. Any Buyer who attempts to perpetrate a fraud upon Seller involving the use of a credit card herewith gives authorization for the Seller to access all credit information about the Buyer from credit reporting agencies and also authorizes the Seller to discover all relevant information from any source about the fraudulent practices of the Buyer and to reveal such information to credit reporting agencies, credit card companies, merchant service providers, and law enforcement agencies.


3. REFUND POLICY

As with all competitors, we do not issue refunds for simply changing your mind. If you experience technical issues with our software, we will work with you to resolve these issues in a timely manner. If these issues can't be resolved, you'll receive a refund. We reserve the right to refund an order and discontinue support and service if you are threatening us or we determine you are using the service for disallowed purposes. Any customer who claims they made a purchase in error or submitted fraudulent information will forfeit their right to any refund and will be held liable for all charges for the transaction. Please be aware that all refunds result in immediate discontinuation of services and support. All sales are final.

4. CONSENT TO JURISDICTION AND FORUM SELECTION

The Purchaser agrees that all actions or proceedings arising in connection with the purchase of products from CLUBMZ.COM, shall be tried and litigated exclusively in the State courts located in the County of Madison, State of Alabama. The aforementioned choice of venue is mandatory in nature, thereby precluding the possibility of litigation between the parties with respect to or arising out of the purchase of products from CLUBMZ.COM in any jurisdiction other than that specified in this paragraph. Purchaser hereby waives any right it may have to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph, and stipulates that the State Courts located in the County of Madison, State of Alabama, shall have in personam jurisdiction and venue over the Purchaser for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to purchase of any product from CLUBMZ.COM. The Purchaser authorizes and accepts service of process sufficient for personal jurisdiction in any action against Purchaser as contemplated by this paragraph by certified mail.
